Kelley Keller is the Founder & President of The Keller Law Firm. Her practice focuses on a broad range of domestic and international intellectual property issues, with an emphasis on trademark and copyright matters, licensing and enforcement of intellectual property rights, and providing counsel and advice on brand expansion and management, domain name disputes, copyright protection, and new media law. She works closely with patent attorneys skilled in various arts to assist clients in determining the best protection strategies for their inventions. Kelley has represented clients across a broad range of industries, including the fields of banking and payments technologies, electronics, supermarkets, manufacturing, pharmaceuticals, telecommunications and entertainment. She counsels clients on use and registration of trademarks in the United States and abroad, including best practices for the selection, adoption, maintenance and enforcement of trademarks, service marks, and other forms of trade identity (trade dress, product design, product configuration, and right-of-publicity). Having a strong back background in copyright matters, she also advises clients regarding registration, licensing, enforcement, and rights-clearance. This often includes providing counsel regarding DMCA (Digital Millennium Copyright Act) compliance and website Terms of Use and Privacy Policy matters. Her copyright experience encompasses a broad spectrum of works of authorship, including paintings/drawings, fabric designs, sculptures, toys, product labels, books, architectural drawings, source code, databases, websites, online works, photographs, and musical works. Kelley frequently negotiates the settlement of pre-litigation disputes, handles opposition proceedings before the Trademark Trial and Appeal Board of the U.S. Patent and Trademark Office, and litigates various intellectual property disputes in the federal courts. Kelley has nearly two decades of experience working with intellectual property matters. She began her career as Director of Continuing Legal Education and International Programs with the National Intellectual Property Law Institute, a non-profit organization in Washington, D.C. In this role, she traveled to nearly two dozen countries working with United States and foreign embassies, and high level government, academic, industry, and judicial personnel around the world on issues related to intellectual property and its relationship to the global trading environment. She also visited numerous research laboratories throughout the country and gained a clear understanding of the technology transfer process from government and university laboratories to the private sector, and relies on that experience in her daily practice of law. Kelley also spent several years working in intellectual property law firms, including the largest IP boutique, and AmLaw 100 firm, in the United States. During this time, she gained broad experience assisting companies doing business at home and abroad, and international companies entering the U.S. market to protect their intellectual property assets. Her legal work comprised transactions in more than 200 jurisdictions around the world and included mega brands such as DISNEY®, TOYOTA®, SAFEWAY®, VERIZON®, BRIDGESTONE®, and TAKEDA® Pharmaceuticals. In 2010, Kelley moved to Carlisle, Pennsylvania and opened The Keller Law Firm. A frequent lecturer on intellectual property issues to entrepreneurs, corporate executives, and other attorneys, Kelley is a Vistage International speaker and an active participant in the Cumberland County Bar Association, Cumberland County Inn of Court, Dauphin County Bar Association, Pennsylvania Bar Association, American Bar Association – Section of Intellectual Property Law, and American Intellectual Property Law Association.
