The Anti-Kickback, Stark and False Claims Acts are intended to ensure that medical / healthcare providers’ judgments are not compromised by improper financial incentives / inducements and are instead based on the best interests of their patients. This program will give viewers an overview of these acts. Among the topics discussed are: • The basic prohibition of each law (i.e., the Federal Anti-Kickback Statute and the Stark Law) • The most common Anti-Kickback Statute Safe Harbors • A basic analytical framework for analyzing potential issues under the Anti-Kickback law and how to apply it in simple scenarios • False Claims Act overview • Case Law and Settlements, what can we Learn? • DOJ Corporate Compliance Program, why a program is important to mitigate damage?
