Speaker Q&A

Question
Are there times when asking a client to waive a conflict might be prudent? For example, when I represent two parties in an amicable simple divorce petition.
- JohnH
Answer
Like anything, no rules are absolute, so asking a client to waive a conflict might be prudent. In any such instance, it is critical to document the conflict and get the jointly represented clients to execute the consents that I outlined in my presentation. I hope that helps. Robert L. Tobey
