Speaker Q&A

Question
Thank you, Craig Dobson, for providing this helpful presentation, which addressed a number of nuances I had previously wondered about! Do you have any thoughts on whether any of the rules you discussed herein govern where one attends CLE? New York State CLE rules, I believe, are silent on where (geography) NYS admitted attorneys may complete their CLE... to illustrate, is it okay for a NYS licensed attorney to remotely attend CLE while out of state, or even out of the US, and still be compliant? Or is this beyond the scope of the points your presentation raises? Thank you again for this helpful presentation, Martha C. Chemas, Esq.

Answer
Martha, I'm not sure about any rules governing the physical location of the lawyer when attending training. However, one issue I see is that lawyers who are licensed in multiple states will sometimes erroneously believe that they are exempt from the CLE requirement in a jurisdiction where they are not physically located. It's always a good idea to read the rules carefully on this and err on the side of caution by completing CLE training for every jurisdiction where admitted. You might be deemed to have practiced in a jurisdiction by speaking over the phone with a client physically located there, etc. Craig Craig Dobson Attorney at Law* Dobson Law LLC *Kenneth Craig Dobson is licensed in New York and Georgia.
